TERMS OF SERVICE

Boostmybusinessonline reserves the right to change or modify any of the terms and conditions contained in this Agreement, any Addendum and any policy or guideline incorporated by reference at any time and from time to time in its sole discretion, and to determine whether and when any such changes apply to both existing or future customers. Any changes or modification will be effective upon posting of the revisions on the Boostmybusinessonline website. Your continued use of Services following Boostmybusinessonline’s posting of any changes or modifications will constitute your acceptance of such changes or modifications.

You must accept the terms of this Agreement in order to use the Services.

PRIVACY POLICY: Our web company shall never share your information with third parties unless required to do so by law or requested by you. The information we collect from you will be used to maintain your services with us and to represent the quality of our work to others, such as in our online portfolio.

OWNERSHIP OF WEBSITE DESIGN: Upon completion of a custom website design and full payment of web design and development fees, the client is the owner of the commissioned website. The client may continue to use the commissioned website to promote the client’s company or organization regardless of whether he/she chooses to continue further services with Boostmybusinessonline. The client does not have the right to resell the design or development to other companies. However the client does have the right to add pages onto the existing site or have another company add pages onto the existing site using the commissioned website design/development.

OWNERSHIP AND COPYRIGHT OF CONTENT: All text and photos used as content in a commissioned website must be provided by the client. The client must have ownership or written permission to use all content he/she provides for use. Boostmybusinessonline cannot be held responsible/liable for copyright infringements on behalf of clients.

PROJECT INITIATION: The initiation of a web design or development project requires a signed work order and upfront payment, as per the quotation, of the initial web design/development fees.

PROJECT TIMELINESS: Boostmybusinessonline cannot complete a website if the client does not provide content (the text and/or photos to be used in the website) or other required elements (pre¬-existing logo or account login information, etc.). If Boostmybusinessonline is waiting for content or other pieces of information, the client will be notified. If the client fails to handle the requests in a timely manner, the website may be delayed.

If the client-¬driven delays continue, Boostmybusinessonline will complete as much of the project as possible without the missing elements. In order to keep all accounts current, Boostmybusinessonline may bill for the completed project and add missing elements later as they are received. If it takes more than 60 days from the website design and build has passed, and the client still has not submitted the remaining missing content, Boostmybusinessonline reserves the right to consider the project complete in its entirety and bill for future work.

Hence Boostmybusinessonline will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines on the client’s side.

HOW CONTENT MAY BE SUBMITTED: All content must be submitted electronically via email (contact us for the correct email address) or on CD mailed to Boostmybusinessonline. Both text and photos/graphics must be clearly labeled with the name of the page on which it will be displayed. Content may not be submitted via fax or paper copies.

HANDLING OF REVISIONS TO A WEBSITE DESIGNED: We take pride in providing attractive designs and the vast majority of our clients are extremely pleased with the designs we have created for them. However design is a subjective art and not everyone’s tastes are the same. While we will gladly make initial minor modifications for no additional charge, it is important to communicate the design preferences at specified time, prior to the commencement of any design work. If the client develops preferences or changes his/her mind after the completion of the work, adjustments will be made by the hour at the rate specified in the quotation.

HANDLING OF WEBSITE MAINTENANCE REQUESTS: Clients who have signed up for a maintenance plan can get the updations done by sending us the details by email. Routine maintenance which fits into the allotted time specified in the client’s maintenance plan is typically completed in about three to four business days. If a client on a website maintenance plan requests more than the scheduled amount of maintenance, he/she will be given a quote and if approved the additional work will be completed and the turnaround time will be based on workload issues. Clients who are not on any maintenance plan may request website updates by purchasing our basic maintenance plan.

After completion of initial website and full payment, any changes required on by you on your website, requires you to purchase a Boostmybusinessonline website maintenance plan.

PAYMENT POLICIES: An advance of 30% of the initial website design and development fees are due upon project initiation. Within 3-4 working days the JPEC layout of the home page is submitted to the client for approval. The client can revert back with feedbacks and suggestions if any for the improvement in the website. Depending upon the volume basically two weeks for a small website, we submit the Html version of the complete website with all the rest pages and animations in a temporary link on the payment of 50% of the balance due payment. Upon project completion, the remaining balance is due in full within five business days. Only once the remaining balance is paid in full, the completed website will be moved from the staging demo server to the client’s server so the website will go live.

Payment for other services such as Domain, Hosting and Website Maintenance are to be paid 100% advance.

DELIVERY DEADLINES: Boostmybusinessonline team works hard to complete all projects in a timely manner. We will provide you with an estimated time of delivery for your project. However, we do not guarantee deadlines as each project is unique and so is each customer. We will communicate with you during the entire development of your project and provide you with status updates. Please understand that additional services, revisions to design or development of your site and delays in providing us with the information we require, or any other reason, will significantly add to the delivery time.

TERMINATION OF SERVICES & REFUNDS: If the client changes his/her mind about doing work with Boostmybusinessonline during the course of the initial web design or development phase, the client will be responsible for the amount of work already completed. Depending on the amount of work completed at the time of cancellation, this may mean receiving a full refund, a partial refund, no refund, or owing additional fees.

Nonpayment will result in legal action being taken if necessary. Once full payment is received for a website, it is assumed that the project has been completed to the client’s satisfaction and no refunds can be offered.

In order to protect clients from unintentional service interruption, clients wishing to terminate any services must request the service termination in writing.

COMPLAINTS PROCEDURE: Informal procedure: Anyone who experiences a problem with their web service provided by Boostmybusinessonline should raise the matter directly to our corporate email id, giving sufficient information to locate the material (such as a url) and clearly outlining the grounds for complaint. Boostmybusinessonline will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.

Formal complaints procedure: The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too serious to be dealt with informally or where a satisfactory conclusion has not been reached after following the informal procedure.

A formal complaint should be made in writing to Boostmybusinessonline, who will acknowledge receipt and ensure that the matter is looked into as soon as possible. An initial response to any complaint can be expected within seven days of its receipt; a full and considered response to the complaint should be completed within 30 days and any subsequent remedy implemented with the minimum delay.

THIRD PARTY VENDORS: Third party vendors may have separate terms of service agreements and Boostmybusinessonline cannot be held liable for disputes with third party vendors.

REFUSAL OF SERVICE: Boostmybusinessonline holds the right to decline to do business with any client for any reason.

CHANGES TO TERMS OF SERVICE: Boostmybusinessonline holds the right to change these terms of services at any time for any reason.
